Call for evidence: ORR Review of train operators’ revenue protection practices


Introduction 

We are carrying out an independent review of train operators’ revenue protection practices, including the use of penalty fares and prosecutions. Our review will inform a report to the Secretary of State for Transport which will make recommendations to the rail industry and government for the benefit of passengers, operators and taxpayers.

This call for evidence is seeking information and details of passengers’ experience where you have boarded a train without a ticket, or with an invalid ticket (for whatever reason), and as a result:

  • Were required to buy a new ticket for your journey or pay an additional fare.
  • Were required to pay a penalty fare, which included the cost of a new ticket.
  • Faced prosecution by the train company.
  • Faced another action by the train company.

Closing date is 17th January 2025.

Scope of the review 

If you have had more than one experience, we encourage you to complete our survey for each one. There is a link on the final page of this survey to bring you back to start a new response.

Please note that we are not able to respond to individual complaints, overturn existing prosecutions, or intervene in any ongoing actions. We will use the evidence provided by individuals solely for the purpose of our review and to inform our final report.

Use of your personal data

We will use your information on an anonymised basis to inform our review, which may also form part of our final published report. We may want to get in touch with some individuals to learn more about your experience. If you are interested, there is an opportunity to provide your name and contact details at the end of the survey.

At the end of the survey, we will ask you some questions about you such as your age, gender, and ethnicity. These questions help us to understand more about how peoples’ experiences vary. These questions are voluntary.

Any personal data you provide to us will be used for the purposes of this survey and will be handled in accordance with our privacy notice which sets out your rights and how we comply with the UK GDPR and the Data Protection Act 2018. The survey data will be kept by ORR for 12 months and then destroyed. SmartSurvey are running this survey on our behalf. You can find their privacy policy here
