Property agents are obligated under the Consumer Protection from Unfair Trading Regulations 2008 not to omit information, which is material to the decision-making process of the average consumer.

Due to perceived difficulties in identifying what constitutes Material Information (MI) in the context of a property agency, the National Trading Standards Estates and Letting Agency Team created and issued guidance in three parts (Part A, Part B, and Part C).

Part A (live from May 2022) and Parts B and C (live from November 2023) have several implications for letting agents. However, it is not known how letting agents view the guidance or the extent to which it has been implemented. This timely survey seeks to:

  • Quantify letting agent awareness and understanding of Parts A, B and C.
  • Identify the extent to which letting agents currently comply with Parts A, B and C.
  • Identify how letting agents comply with Parts A, B and C. 
  • Understand letting agent views on the benefits and challenges associated with the provision of MI.
  • Identify letting agent views on how the provision of MI might be improved.

The survey could take between 15 and 20 minutes to complete. However, it is possible to partially complete the survey, save your progress, and continue the survey at a later time.
